AGREEMENT AND PARTIES Litwin Books, LLC, a California limited liability company doing business in California as Library Juice Academy (“Company,” “us,” or “we”) respects the privacy of the visitors to the www.libraryjuiceacademy.com website (“website” or “site”). This privacy policy (“privacy policy” or “policy”) is an agreement between Company and you, as the user of the website (“you”). We reserve the right to change this privacy policy at any time in our sole and absolute discretion. Changes, modifications, additions, or deletions will be effective immediately on their posting to this site. You should check this policy periodically as its terms may change from time to time. DISCLAIMER. The privacy policy does not extend to anything that is inherent in the operation of the Internet, and therefore beyond Company’s control, and is not to be applied in any manner contrary to applicable law or governmental regulation. This online privacy policy only applies to information collected through this site. This privacy policy does not apply to any information we may collect from you in any place other than this website.

TYPES OF INFORMATION COLLECTED. 5.1 In-Class/Platform Data.
We will also collect other information regarding your participation and communication arising out of and relating to classes you attend. This includes, without limitation, class participation communications, in-platform communications with instructors, and assignments that are submitted to instructors. We will aggregate this information for statistical use to improve our classes, communications, and the user experience on the site. This includes, without limitation, aggregating the data to find patterns in the in-class communications and assignment submissions. The statistical information as a result of the aggregation may be share with third parties, in our sole and absolute discretion, to improve the user/student’s experience on the site. If this information is shared, no personal information will be associated with or viewable in this data or shared with third parties, only general statistical information.

6. GENERAL INFORMATION WE MAY COLLECT

TYPES OF INFORMATION COLLECTED. There may be other instances in which we collect information from you that is more general in nature (“general information”). Such information may include your Internet Protocol (IP) address, which enables us to identify your computer or device on a Transmission Control Protocol/Internet Protocol (TCP/IP) network, which includes the World Wide Web. Your computer has an IP address, which is required for you to communicate with others via the Internet. Such general information, including the click stream data and cookies, as mentioned below, may be collected from you whenever you access the site, whether or not you provide us with any personal information.

6.1. Click Stream Data
When you visit our website, we may also collect “click stream data” (server address and domain name). This information can be combined with information you have provided to us by registering. 6.3. Information Submitted in Moodle and on Blogs
Company hosts a third-party, open source learning platform on its site, Moodle. When you log into the site, you may be directed to the portion of the site that hosts the Moodle platform, which is a learning platform designed to provide educators, administrators and learners with a single robust, secure and integrated system to create personalized learning environments. You may submit information on the site through this platform via messages and other means of communication. You may also comment on blog posts on the site, where you may disclose certain information. While Company’s policy is to not collect or otherwise use this information, you hereby acknowledge that any information submitted on the Moodle platform or on the blog may be used in accordance with the terms of this policy and is otherwise subject to this policy.

7. GENERAL INFORMATION ABOUT YOU

USE OF GENERAL INFORMATION. We will primarily use the personal information you provide and any general information we receive from you to provide products and services to you, including, but not limited to, information or materials via e-mail that you request, notifications regarding activity on the Moodle platform, and other industry news and information, which may be about the Company as well. By registering on the site or signing up for the mailing list, you have consented to receive these e-mails. If you no longer wish to receive any e-mails from us, or if you want to modify your personal data or want your personal data to be deleted from our database, see Section 12.

8. PROTECTION OF YOUR PERSONAL INFORMATION AND GENERAL INFORMATION

8.1. Security Measures
In order to protect both the personal information and the general information that we receive from you through our website, we have implemented various security measures common in the industry to protect your information.

The servers that make Company’s website available may be located throughout the United States, and in some cases other countries in the world. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful, as determined in our sole discretion. 10.4. Links to Third Parties
PURPOSE OF LINKS. For your convenience and to improve the usage of the website we may insert links to third parties on this site. This privacy policy does not apply to such third-party websites. These links take you outside our service and off the Company’s site and are beyond our control. This includes links from partners that may use Company’s logos as part of a co-branding agreement or other arrangement, such as Mal’s E-commerce payment processing platform. The sites those links can take you to have their own separate privacy policy and although we seek to protect the integrity of our site, Company is not liable for the content and activities of those sites. Your visits and access to such websites is at your own risk. Please note that those other sites may send their own cookies to users, collect data, or solicit personal information.

No waiver of any term, provision, or condition of this policy, whether by conduct or otherwise, shall be deemed a further or continuing waiver. If any provision or part of this policy is found to be invalid or unenforceable, the remaining provisions shall nevertheless remain valid and enforceable.

15. DISPUTE RESOLUTION
You agree that any and all disputes regarding this policy which cannot be resolved in a reasonable time shall be submitted to arbitration in Sacramento County, California, before a sole arbitrator selected from Judicial Arbitration and Mediation Services, Inc., or its successor (“JAMS”), or if JAMS is no longer able to supply the arbitrator, such arbitrator shall be selected from the American Arbitration Association, and shall be conducted in accordance with the rules and procedures of JAMS. JAMS is the exclusive forum for the resolution of such dispute. Final resolution of any dispute through arbitration may include any remedy or relief which the arbitrator deems just and equitable, including any and all remedies provided by applicable state or federal statutes
